What We Handle

Our New Build Conveyancing Services

We act for buyers across all types of new build purchases — from apartments in large developments to individual new build houses.

New Build House Purchase

We act for buyers of new build houses, managing the developer's contract pack, raising enquiries with the developer's solicitors, satisfying mortgage conditions, and handling exchange and completion.

New Build Apartment Purchase

New build apartments are leasehold properties requiring review of the lease, service charge provisions, building warranty documentation, and the developer's management arrangements.

Off-Plan Purchase

Buying off-plan — before the property is built — involves exchanging contracts on an unfinished property. We advise on the specific considerations involved and manage the transaction through to completion when the property is ready.

Shared Ownership New Build

Shared ownership new build purchases involve additional documentation from the housing association alongside the developer's pack. We act for shared ownership buyers and are experienced with housing association requirements.

New Build Buy-to-Let

Investors purchasing new build properties for rental require specific advice on the developer's documentation and any restrictions on lettings. We act for buy-to-let purchasers on new build transactions.

Building Warranty & Documentation

We review the building warranty documentation — such as NHBC Buildmark or equivalent — and report to you and your lender on the cover provided as part of the transaction.

How New Build Differs

What Makes New Build Conveyancing Different

New build transactions are more involved than standard resale purchases. Developers operate on their own timescales and with their own documentation — and buyers need a solicitor who is experienced in dealing with developer packs and tight exchange deadlines.

Our team is familiar with the major developers operating across London and the documentation they typically produce. We manage the process efficiently to meet developer deadlines while ensuring your interests are protected throughout.

Speak to Our Team

Exchange Deadlines

Developers typically require exchange of contracts within 28 days of reservation. This is a tight timescale — our team prioritises new build matters to ensure all checks are completed and you are ready to exchange within the developer's deadline.

Developer Contract Pack

The developer's solicitors prepare the contract documentation. We review the full pack on your behalf, raise enquiries where needed, and report to you on the terms before you are committed to the purchase.

Building Warranties

New build properties come with a building warranty — most commonly NHBC Buildmark or a similar scheme. We review the warranty documentation and confirm its terms to you and your mortgage lender as part of the transaction.

Completion on Notice

On many new build purchases, the developer serves notice of the completion date once the property is ready. We manage this process and coordinate with your mortgage lender to ensure funds are in place for completion day.

Who We Act For

New Build Buyers We Advise

01

First-Time Buyers

New builds are popular with first-time buyers, particularly through shared ownership and Help to Buy schemes. We advise first-time buyers on the process and what to expect at each stage.

02

Home Movers

Buyers selling an existing home and purchasing a new build simultaneously — where timing of the sale and the new build completion need to be carefully managed.

03

Buy-to-Let Investors

Investors purchasing new build properties for the rental market, including those acquiring multiple units within the same development.

04

Shared Ownership Buyers

Buyers purchasing a share of a new build property through a housing association shared ownership scheme.

05

Off-Plan Buyers

Buyers exchanging contracts on a property that is not yet built, often many months before the anticipated completion date.

06

Cash Buyers

Cash purchasers of new build properties who require the same thorough review of the developer's documentation without the additional mortgage lender requirements.

Common Questions

New Build Conveyancing FAQs

The time from instruction to exchange on a new build is typically four to eight weeks, depending on how quickly the developer's solicitors provide the contract documentation and how promptly enquiries are resolved. Completion follows when the developer serves notice that the property is ready — which may be weeks or months after exchange, depending on the stage of construction.
Most developers require a reservation fee when you agree to purchase a new build property. This takes the property off the market during the conveyancing process. Whether the reservation fee is refundable — and in what circumstances — depends on the developer's specific terms. We review these terms as part of our initial advice and flag anything you should be aware of before proceeding.
Developers typically set a deadline — often 28 days from reservation — by which exchange of contracts must take place. If the deadline is not met, the developer may withdraw from the sale and retain the reservation fee. We manage the process to ensure all requirements are met ahead of the exchange deadline.
NHBC Buildmark is the most widely used building warranty for new homes in the UK. It provides cover against certain defects in the construction of the property for a period of years after completion. Most mortgage lenders require an NHBC or equivalent warranty before they will lend on a new build property. We review the warranty documentation as part of the transaction and confirm the details to you and your lender.
If you are purchasing with a mortgage, your solicitor must be on your lender's approved panel. Kenton Solicitors is accepted by all major mortgage lenders. It is also advisable to use a solicitor with experience in new build transactions, as the documentation and timescales involved differ from standard resale purchases.
