Are These Agreements Actually Binding?

Not automatically — and any firm telling you otherwise is overstating it. A court is not strictly obliged to follow what you agreed.

In practice, though, a properly prepared agreement carries real weight and is usually upheld. What makes the difference is how it was put together: both of you being open about your finances, each taking your own independent advice, neither being pressured, it being signed well before the wedding, and the terms being reasonable rather than leaving one of you with nothing.

Get those things right and the agreement is likely to hold. Cut corners on any of them and it may not be worth much when it matters. That is the whole reason for having it drawn up properly.

An agreement signed in the last few weeks before a wedding is far easier to challenge, because of the pressure involved. Aim to have it finalised at least a month beforehand, ideally longer.

Both of You Need Your Own Solicitor

Yes. A post-nuptial agreement can be made at any point during the marriage and works in the same way. Couples often put one in place after an inheritance, when a business is started, or simply because they never got round to it before the wedding. It carries similar weight, and in some ways it is easier because the pressure of an approaching wedding is not there.
An agreement cannot restrict what is provided for children — their needs are considered separately whatever the agreement says. Children arriving is also one of the main reasons an agreement should be reviewed, as terms that were reasonable for a couple may not be reasonable once there is a family to house and support.
